Why do I need a lawyer?

Sometimes I talk to people who feel that hiring an attorney will only mean less money for them and they ask "Why should I hire one?" Several insurance companies have even sent victims of accidents or mishaps brochures or letters stating the same thing. Remember, an insurance company for the party who caused your injury has only one interest in mind, to settle your claim for the least amount of money possible.

Many claims for injury can have more than one cause or party responsible for causing the injury or death. Automobile, motorcycle or other vehicle accidents can be caused by not only a careless or reckless driver but a defective product or a road that is defectively designed or maintained. The driver of the "at fault" vehicle could have been served intoxicants even after the driver was visibly intoxicated. A doctor may commit malpractice which causes an injury to become more severe or even cause death. All of these claims involve acts by people who were not at the scene of the accident.

The insurance company for the "at fault" driver doesn't care about any of these claims. The adjuster's goal is to get their insured out of the claim as quickly and as inexpensively as possible. By settling with the driver's insurance company without first talking with an attorney, you may lose the right to pursue the other parties at fault for your injury or loved one's death.

Most releases release everybody on God's green earth, and when you sign it you release anyone who may be responsible for causing your injury — not just the insured. Additionally, some claims are barred if you settle your claim with the immediate person who caused the death or injury. You are prohibited by state law from pursuing a dramshop claim against a bar or establishment who serves the at fault driver after he/she is visibly drunk if you settle with that driver's insurance company. You may lose the right to be compensated by your own insurance carrier for under-insured motorist coverage if you settle with the "at fault" person.

Only an experienced attorney who specializes in pursuing these types of claims can make sure that you are not giving up valuable rights to additional compensation by settling too fast. There are many other instances where you can cause more harm than good by acting on your own. Usually the "at fault" driver has limited insurance which may not adequately compensate you for the actual loss you have suffered. Do you want to take that risk?
